1. Introduction

These General Terms and Conditions (hereinafter referred to as GTC) contain the terms of use for the services available on the [kindermobel.hu] website (hereinafter: the website) by the user (hereinafter: User).

The technical information required to use the website that is not included in these GTC is provided on the website.

By using the website, the User acknowledges and accepts the provisions of these GTC.

3. Activities carried out on the website

The Kindermöbel Baby Center engages in the retail of its own manufactured baby furniture and the distribution of other related products on this website.

4. Terms of Use

4.1. Liability

The User may use the website solely at their own risk and accepts that the Service Provider shall not be liable for any material or non-material damages arising during the use, except for damages caused intentionally, by gross negligence, by a criminal act, or for liability for breach of contract resulting in harm to life, bodily integrity, or health.

The Service Provider excludes all liability for the conduct of users of the website, and the User is fully and exclusively responsible for their own conduct.

The User must ensure that the use of the website does not directly or indirectly infringe the rights of third parties or legal regulations.

The Service Provider is entitled, but not obliged, to monitor content (e.g. comments) made available by Users on the website and is entitled, but not obliged, to search for indications of illegal activities in such content, and assumes no responsibility for them.

4.2. Copyright

The entire content of the website (texts, images, graphic elements, etc.) is protected by copyright and is the property of Viarex Kft. Copying, modifying, or distributing them is prohibited!

5. Purchasing on the website

5.1. Ordering process

The website provides product presentation and online ordering opportunities for Users.

Users may browse the website using the menu items.

Products are categorized into a category system.

All discounted products available in the store are listed in the “Discounted Products” category. Each product includes the start and expiry date of the promotion, or the start date and the indication “while stocks last.”

The “New Arrivals” menu shows the newly introduced products in the website’s offer.

Clicking on the category name displays the list of products contained in it. If all products in the category do not fit on one page, navigation is possible using the numbers above and below the list. The detailed product page is available by clicking on the product name, where you can find detailed characteristics and prices of the desired product.

It is also possible to search for products by keyword. Search results are displayed in a list similar to categories.

The selected product can be placed in the cart using the “Add to Cart” button, and the quantity can be adjusted next to the button. The User can check the cart contents under the “Cart” menu. Here, they can change the quantity ordered or delete the item. The entire cart can be emptied with the “Empty Cart” button. The User can proceed with the purchase process by clicking the “Order” button.

In the second step, the User may log in, register, or purchase without registration.

For registration and purchase without registration, the User must provide the following data: email address, name, phone number, billing address, and shipping address if different from the billing address.

For registration, in addition to the above data, a password must also be provided. Successful registration is confirmed via email and on the website. The User may request the deletion of their registration via email, in which case a new registration will be required for further purchases. The User is responsible for keeping login details confidential. The User is also responsible for updating their data and must notify the Service Provider if they become aware that their data has been misused by a third party. In case of a forgotten password, a new password can be requested for the registered email address. If the User has previously registered, the order process can continue by entering their email address and password.

In the next step of the order, the User must select the desired payment and delivery method. A summary page allows the User to check all previously entered data, the ordered products, and their quantities. Data entry errors can be corrected using the pencil icon. If everything is correct, the User can finalize the order by clicking the “Send Order” button. Confirmation is sent on the website and via email. If incorrect data is detected after order placement (e.g. in the confirmation email), it must be reported immediately, but no later than within 24 hours, to the Service Provider.

Regardless of order placement, Users can log in via the “Customer Login” window or the “Login” menu. After logging in, the “Modify Data” menu appears, where they can modify the data provided at registration, and track the details and status of their orders.

Viewing prices and adding products to the cart does not require login.

Currently, online payment is not available.

5.2. Binding offer, confirmation

The Service Provider shall inform the User of the confirmation within 48 hours. If the User does not receive confirmation within 48 hours, the User is released from their binding offer and is not obliged to accept the ordered products.

The confirmation email contains the data provided during purchase, the order details, the name and price of the ordered product(s), the chosen payment and delivery method, the order number, and any comments made by the User regarding the order.

5.3. Conclusion of the contract

The contract may be concluded in Hungarian. Submitting the order constitutes a contract concluded electronically, which is governed by Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society.

The contract falls under Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses and takes into account Directive 2011/83/EU of the European Parliament and of the Council on consumer rights.

The contract is concluded upon receipt of the automatic confirmation.

In addition to the automatic confirmation email, the Service Provider will send a second email (separate acceptance email) within 48 hours, accepting the User’s offer, and thus the contract is concluded upon receipt of this acceptance email by the Service Provider, not by the automatic confirmation email.

5.4. Filing of the contract

Contracts concluded through the website do not constitute written contracts, the Service Provider does not file them, and they are not accessible afterwards.

5.5. Invoice

The Service Provider issues a paper invoice, which is sent with the package upon order fulfilment, or delivered by post or electronically via email to the customer.

If the User requires separate invoices for certain items, this must be indicated when placing the order or through customer service.

5.6. Payment

5.6.1. Advance transfer

Based on the order, the Service Provider prepares the invoice and sends a copy to the User.

The order confirmation email contains the necessary details for the bank transfer.

IMPORTANT: Packages are sent only after the purchase price is credited to our bank account.

The Service Provider informs the User about the expected delivery time.

5.6.2. Cash on delivery

Based on the order, the Service Provider prepares the package and the invoice, which the User pays in cash or by card upon delivery.

5.7. Collection and delivery options

5.7.1. Courier service

If home delivery is chosen, the order will be delivered by courier service.

Delivery is available on weekdays, Monday to Friday, between 8:00 a.m. and 5:00 p.m., within Hungary.

IMPORTANT: Please request delivery to an address where someone is available during this time frame.

Upon dispatch, the courier service will notify the recipient by email or SMS about the next working day delivery.

If delivery fails, the courier will leave a notice and a new delivery time can be arranged using the provided contact details.

Upon receipt, the User must check whether the product is undamaged.

If any damage is detected on the packaging or the product, the User may request a report from the courier. By accepting the package and signing the delivery document, quantitative and qualitative acceptance of the product is deemed to have taken place, meaning that after the courier leaves, the User may only exercise the right of withdrawal, and the Service Provider cannot accept later complaints regarding quantity or quality.

If at the time of receipt the packaging or product is visibly damaged and the damage clearly occurred before acceptance, the Service Provider will provide a replacement or return free of charge.

The Service Provider accepts no liability for damage detected after receipt!

Delivery costs

Delivery charges for furniture vary depending on weight. Product prices do not include delivery costs, which will be added to the total at checkout.

Delivery time:

For products in stock: 2-5 working days.

For products not in stock: we will inform you about the expected production and delivery time.

Unless otherwise agreed, the Service Provider must deliver the product to the Consumer without delay, but no later than within sixty days of concluding the contract.

In case of delay, the Consumer may set an additional deadline. If the Service Provider still fails to deliver, the Consumer may withdraw from the contract. The Consumer may withdraw without setting an additional deadline if the Service Provider refuses to perform or if the contract, by agreement or by the intended purpose of the service, was to be performed at a specified time – and not later.

5.7.2. Personal collection

The ordered product(s) may also be collected in person at our customer service during an agreed time.

Products can be collected Monday to Friday between 9:00 a.m. and 4:00 p.m.

Upon collection, the customer must check whether the product is undamaged and whether all parts and accessories are received. The Service Provider accepts no liability for damage detected after collection.
